Clare County Council has submitted a new application to An Bord Pleanála seeking approval for the compulsory acquisition of a derelict site in Kilkee.
An earlier application, relating to the former Waterfront bar and nightclub at the corner of Marine Parade and O'Curry Street in the west Clare town has been withdrawn by the local authority.
It's understood the owner of the property is challenging the council's intention to CPO it which is why An Bord Pleanála is being asked to adjudicate the matter.
According to An Bord Pleanála's website, the first application relating to the two storey commercial premises and surrounding site, was withdrawn on January 8, 2024 - having been first submitted last November.
Clare County Council confirmed this with a spokesperson stating that a new application has been submitted.
"It was the submission of an appeal made by a person who owns property on which a Compulsory Purchase Order under the Derelict sites Act, 1990 was submitted to An Bord Pleanála for adjudication.
"While the initial application to An Bord Pleanála was withdrawn, another application in relation to the same matter has been submitted," they said.
A decision is due by the summer.
